Welcome to HalalKhao. By downloading, installing, or using the HalalKhao mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you ("User") and HalalKhao ("we", "our", or "us"). By creating an account or using any feature of the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement.
2. Description of Service
HalalKhao is a mobile application that helps users discover halal restaurants in the Washington DC, Maryland, and Virginia (DMV) area. The App provides restaurant listings, directions, user reviews, prayer times, mosque locations, and related features. Some features require a paid premium subscription.
3. User Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at halalkhao@outlook.com if you suspect unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Premium Subscription
HalalKhao offers a premium subscription ("HalalKhao Premium") that unlocks additional features including unlimited favorites, review writing, advanced filters, mosque locations, offline mode, and an ad-free experience.
- Pricing: $1.99 per month, with a 7-day free trial for new subscribers.
- Billing: Subscriptions are billed through your Apple App Store or Google Play account. Payment is charged to your account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Free Trial: The free trial automatically converts to a paid subscription unless cancelled before the trial period ends. You will not be charged if you cancel before the trial ends.
- Cancellation: You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
- Restore Purchases: If you reinstall the App or switch devices, use the "Restore Purchases" option in the App to recover your subscription.
- Refunds: Refund requests are handled by Apple or Google in accordance with their respective refund policies.
5. User-Generated Content
You may submit reviews, ratings, and photos ("User Content") through the App. By submitting User Content, you:
- Grant HalalKhao a non-exclusive, royalty-free, worldwide license to display and use your User Content within the App.
- Represent that you own or have the right to submit the content.
- Agree not to submit content that is false, defamatory, offensive, harassing, or in violation of any third-party rights.
We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without notice.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to any part of the App or its infrastructure.
- Scrape, crawl, or systematically extract data from the App.
- Reverse engineer, decompile, or disassemble any part of the App.
- Submit false, misleading, or fraudulent reviews or information.
- Impersonate any person or entity.
- Interfere with or disrupt the App's servers or networks.
7. Restaurant Information Accuracy
HalalKhao strives to provide accurate and up-to-date restaurant information, including halal certification status, hours, and contact details. However, we do not guarantee the accuracy, completeness, or timeliness of any listing. Restaurant details including halal status may change without notice. Always verify halal certification directly with the restaurant before dining.
8. Location Services
Certain features of the App require access to your device's location. Location data is used solely to provide nearby restaurant results and is not stored on our servers. You may disable location access in your device settings at any time, though this will limit certain App functionality.
9. Intellectual Property
All content in the App — including but not limited to the HalalKhao name, logo, design, text, graphics, and software — is owned by or licensed to HalalKhao and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
10. Third-Party Services
The App integrates with third-party services including Google Firebase, RevenueCat, and prayer time APIs. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HALALKHAO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless HalalKhao and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App, your User Content, or your violation of these Terms.
14. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
15. Governing Law
These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Maryland.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
